2. Description of Service

Thawly is an AI-powered productivity tool designed to help individuals, particularly those with ADHD, break down overwhelming tasks into manageable micro-steps. The Service includes a free tier with limited daily usage and a paid Pro subscription with unlimited access and additional features.

3. User Accounts

You may use certain features of the Service without creating an account. To access Pro features, you must register using Google OAuth. You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Subscriptions and Payment

Free Tier: Provides up to 3 AI-powered task breakdowns per day at no cost.

Pro Subscription: Provides unlimited daily task breakdowns, cloud-synced history, and additional features. Pro subscriptions are billed monthly ($9.90/month) or annually ($59/year), and renew automatically unless cancelled.

Payment Processing: All payments are processed securely through Creem.io. By subscribing, you agree to Creem's terms of service.

Price Changes: We reserve the right to adjust pricing. Any changes will be communicated in advance and will take effect at the start of the next billing cycle.

5. Cancellation and Refunds

You may cancel your Pro subscription at any time through your account dashboard or the Creem customer portal. Upon cancellation, you will retain access to Pro features until the end of your current billing period.

We offer a 7-day money-back guarantee for first-time Pro subscribers. If you are unsatisfied, contact us at support@thawly.ai within 7 days of purchase for a full refund. Refunds are generally not provided for subsequent renewal periods unless required by applicable law.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Input content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers) to access the Service without our written consent
• Resell, redistribute, or commercially exploit the Service without authorization

7. AI-Generated Content

The task breakdowns and suggestions provided by the Service are generated by artificial intelligence. While we strive for helpful and accurate outputs, AI-generated content may occasionally be inaccurate, incomplete, or inappropriate. You acknowledge that:

• AI outputs are suggestions, not professional advice
• You are responsible for evaluating and acting on any suggestions
• We are not liable for actions taken based on AI-generated content

8. Intellectual Property

The Service, including its design, code, content, and branding, is the property of Thawly and is protected by intellectual property laws. You retain ownership of any content you input into the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Thawly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

11. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We may revise these Terms from time to time. Material changes will be communicated by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
